Terms of Use

These Terms of use (“Terms”) describe the rules for using the I’m Good App and application (collectively, the “Service”). The purpose of the Service is to enable friends and family to regularly check in with loved ones remotely to ensure they are okay (the “Services”). Terms such as “we”, “our”, “Company”, “the App”, or “I’m Good” refer to [O2 Consulting, LLC.] and its affiliate entities. We will post any changes to the Terms on this page for the Service. 

This Service is intended for use within the United States. These Terms do not apply to the practices of third-party services the Company has a relationship with or to other companies or individuals that the Company does not own, employ, manage, or control.

ACCOUNT REQUIREMENTS

You must create an account with a unique identifier to use the Service. The App requires using either an email address or a cell phone number along with a password to create an account. The App will not function without an account, so if you wish not to provide a valid email address or a valid cell phone number, we recommend that you do not use the App. Please refer to our Privacy Policy — https://www.o2consulting.us/im-good-privacy — for information about how we protect your personal information.

You are responsible for ensuring that any personal information you provide is accurate and up to date.  You should notify the Company immediately if you believe your user identification, password or other identifying information has been lost, stolen, or otherwise compromised.  You are solely responsible for all damages or claims that may arise from any access to or use of this Service by any person to whom you have provided your user identification, password or other identifying information, or by any person who has obtained such information from you, including, but not limited to, any access to or use of this Service that may occur after you have notified us that your user identification, password or other identifying information has been lost, stolen or otherwise compromised.

All rights, title, and interest in and to the Service and all intellectual property rights, including all copyright, trademark, patent, and trade secret rights therein shall remain with the Company and our licensors and vendors.

We may terminate your access to the Service at any time for any reason. 

RESTRICTIONS ON USE OF THIS SERVICE

You may not:  

  • Use this Service in any way not explicitly permitted by these Terms or the text of the Service itself;

  • Misrepresent your identity or provide us with any false information in any information-collection portion of this Service, such as a registration or enrollment application page;

  • Take any action intended to interfere with the operation of this Service;

  • Access or attempt to access any portion of this Service to which you have not been explicitly granted access;

  • Share any password assigned to or created by you with any third-parties or use any password granted to or created by a third-party;

  • Directly or indirectly authorize anyone else to take actions prohibited in this section;

  • Violate applicable laws or regulations while using this Service.

NO WARRANTIES

THE INFORMATION IN THIS APP IS PROVIDED “AS IS” WITHOUT ANY WARRANTY, CONDITION OR REPRESENTATION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY WARRANTY RESPECTING NON-INFRINGEMENT, AND THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 

LIMITATION OF LIABILITY

THE COMPANY AND AFFILIATES (“SERVICE-RELATED-PARTIES”) SHALL NOT BE LIABLE FOR ANY DAMAGE RESULTING FROM YOUR USE OF OR INABILITY TO USE THIS SERVICE. THIS PROTECTION COVERS CLAIMS BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, AND ANY OTHER LEGAL THEORY. THIS PROTECTION COVERS THE SERVICE-RELATED-PARTIES, INCLUDING ALL AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS. THIS PROTECTION COVERS ALL LOSSES INCLUDING, WITHOUT LIMITATION, DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, AND PUNITIVE DAMAGES, PERSONAL INJURY/WRONGFUL DEATH, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION.  IF YOU ARE DISSATISFIED WITH THIS SERVICE OR THE SERVICES, YOU SHOULD STOP USING THE SERVICE.

YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE, INCLUDING BUT NOT LIMITED TO ALL CONTENT, ALERTS, STATUS, PRODUCTS, OR MERCHANDISE ARE PROVIDED ON AN “AS IS”, “WITH ALL FAULTS”, AND “AS AVAILABLE” BASIS WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND.

The Company shall not be held responsible for any injury, theft, death, or medical emergency experienced by any users of the App at any time. The Company shall not be held responsible for any defect or service outage within the App at any time.  The App is not to be used as any type of emergency response tool of any kind; and as a result, neither the App nor the Company can be held accountable for any damages related to any emergency or situation of any kind. If you or anyone you know who is using the App experiences an emergency of any kind, or cannot be contacted using the App, contact appropriate emergency authorities immediately. The App is not intended to be used as an emergency response tool of any kind and using it as such violates all Terms of use.
